Meta tendrá que pagar US$174 millones por violación de patentes

La casa matriz de Facebook e Instagram fue condenada a pagar una millonaria multa por daños y perjuicios a Voxer, una aplicación que acusó al gigante de las redes sociales de violar sus patentes.

Un jurado de corte federal de Texas determinó que el modo “en directo” que Meta utiliza para Facebook Live e Instagram Live incluye tecnología patentada por Voxer.

El proceso judicial se abrió en la ciudad de Austin la semana pasada. Meta, según indicó un portavoz, busca apelar la decisión: “pensamos que las pruebas presentadas durante el proceso muestran que Meta no infringió las patentes de Voxer”.

Voxer interpuso las denuncias en 2020, asegurando que el grupo californiano se había servido de tecnología patentada tras el fracaso de un intento de colaboración entre las dos empresas en 2012.

La aplicación móvil permite “la transmisión de comunicaciones, audio y video con la inmediatez del directo y la fiabilidad y facilidad de una mensajería”, según la demanda, incluso en malas condiciones de red y aun si el destinatario no está disponible.

Voxer segura que fue contactado por Facebook poco después del lanzamiento de su servicio en 2011, el cual fue un “éxito inmediato”. Los abogados dicen que la empresa habría dado entonces detalles de su tecnología a la red social, pero “las reuniones no llegaron a un acuerdo”.

“Facebook entonces identificó a Voxer como un competidor, incluso cuando no había, en ese momento, herramientas de video o de audio en directo”, indica la denuncia.

“Facebook revocó el acceso de Voxer a elementos claves de la plataforma y lanzó Facebook Live en 2015 y después Instagram Live en 2016. Los dos productos tienen tecnologías de Voxer y violan sus patentes”, afirma el denunciante.
